The property is located at the corner of Ocean Avenue and Morris Avenue. It spans eight-tenths of an acre and includes the 9,600-square-foot motel that was built in 1958 and on-site parking.
Kushner is looking to acquire a city-owned right-of-way measuring about 17 feet by 120 feet to the west motel to expand the footprint of the property. Hayes said the city has no use for the property and after a brief discussion during its Dec. 9 meeting, the Long Branch Council agreed that it would be willing to get rid of the property.
Hayes said the neighbor to the west of the motel has said she does not wish to acquire the right-of-way.
City Attorney James Aaron said the city cannot receive any money for vacating the property.
"By statute you either have need for the property and keep it or you decide you have no need for the property and vacate it," Aaron said. "There is no monetary give back by any property owner."
